There are times when you want to glue your video together, and put on the background (for example) some kind of melody that you found on the Internet. You are with a calm soul, being sure that if the song is in free access, then it’s okay, put it on the background. In a month, your video will be deleted (at best) or your channel will be permanently blocked. The reason for this was copyright infringement of music that you took without demand.
What pieces of music can I take for free?
There are several ways to take music for free without violating copyright.
One of these options is audio banks (for example, a music library in Youtube studio mode). Yes, there are special services where the authors post their tunes without requiring anything in return. There are such services, but with the condition of specifying the author of the melody. Either way, it’s one of the easiest ways to use content for free.
The second option is to use classical music. But there is one catch. Classical music in our case will be considered notes. You cannot use the performance of classical music, for example, some kind of orchestra, because already related rights will be violated.
The third and final option is citation. The condition for using the work as a quote will be just the indication of the author and the date of creation of the work. But that doesn’t mean you can shove the whole piece in. It is allowed to quote only part of the work (and again such not 90% of the work, but within a reasonable framework).
How can I ask an author to let me use his music?
Everything is very simple. First, you need to find the author. After, write to him with a request to allow him to use his melody. At the same time, you must describe to him why you need it, where you will use it, for how long you want and other points. If the author agrees to provide you with such a melody for free, be sure to request WRITTEN permission. This can be in the form of a license (as an option).
Important points in obtaining permission from the author
Be sure to check with the author in what way he allows you to use his work. Maybe he allows you to use his music when creating a song, but, for example, when editing a video from a trip, you can get a refusal.
What are the consequences of copyright infringement?
Copyright violations, at the expense of the subject of our article, concern the property rights of the author. Such a violation in the laws and other acts of Ukraine is counterfeiting (piracy). Responsibility can be of 2 types:
- Administrative: such liability is provided for by Art. 51-52 of the Code of Administrative Offenses of Ukraine and imposes on the subject who illegally used the copyright object a fine in the amount of 10 to 200 non-taxable minimums of income of citizens with confiscation of illegally manufactured products and equipment for its creation.
- Criminal: such liability is provided for by Art. 176 of the Criminal Code of Ukraine. According to this article, intentional illegal reproduction, distribution of copyright objects, if it caused material damage in the amount of UAH 340, is criminally punishable. Such violation of copyright entails a fine from UAH 3,400 to UAH 51,000. Or correctional work up to 2 years, or imprisonment for up to 6 years, with confiscation and destruction of all copies of works
