IS MY COURSE COPYRIGHTED?
Any training, educational program, teaching method or course of lectures is protected by copyright. Article 11 of the Law of Ukraine “On Copyright and Related Rights” contains a norm that establishes the fact that the author’s copyright arises from the moment of creation of any work, including your course, teaching methodology, etc. That is, you have created your own course – you have a copyright.
Copyright protection applies only to the form of objects, but not to the content. Therefore, if you have written a course, a method for losing weight, in which you have shown a method of obtaining, for example, a large amount of fats and carbohydrates in a short time, copyright does not prohibit third parties from using such a method. However, the form of presentation of this method will be protected by copyright. In essence, copyright protects not the idea, but its material embodiment.
WHAT IS THE PERIOD OF COPYRIGHT?
The legislation of Ukraine provides for the protection of property copyrights for the lifetime of the author and 70 years after his death. But the author’s non-property rights are protected indefinitely.
DO I NEED TO REGISTER COPYRIGHT FOR MY OWN COURSE?
In Ukraine, the creation and exercise of copyright does not require mandatory state registration of the work or completion of other formalities, but we recommend, like most experts in the field of intellectual property, to register the copyright of the work. The certificate of copyright registration, issued by the authorized state bodies of Ukraine, is the most important proof of copyright ownership, and also records the date of creation of the work.

The essence of registration:
- It is optional, it is a right and not an obligation of the author or other subject of copyright.
- A Certificate of the established model or Decision (when registering contracts concerning the author’s right to a work) of NIPB (national intellectual property body) is issued, the functions of
- which are performed by the State Enterprise “Ukrpatent”, which is subordinate to the Ministry of Economy of Ukraine.
