Registering a trademark for clothing in Ukraine and worldwide

     The process of registering a trademark for clothing in Ukraine and around the world is an important procedure for protecting intellectual property for businesses. Registration of a trademark grants the owner exclusive rights to use this trademark in production, sales and marketing, which allows the brand to distinguish itself from competitors and maintain its uniqueness in the market.

Ukrainian law provides for the protection of intellectual property, including trademarks. The process of trademark registration in Ukraine is carried out through the Ukrainian National Office of Intellectual Property and Innovations (UANIPIO). Owners may file an application for trademark registration, which will be reviewed and found eligible if all requirements are met.

The registration process involves filling out an application, submitting the necessary documents, conducting an examination for compliance with the requirements and paying the relevant fees. With the increase in the territories of registration of the mark, this difference in fees increases, that is, the more countries there are, the cheaper the registration in each country is compared to national procedures. Payment of fees – is made in one payment to the Geneva office – in Swiss francs for all territorial registrations of a trademark (except for Japan – there are some peculiarities and several payments).

The language of correspondence with patent offices is one selected language of office work, for example, English, but some patent offices (e.g., Moldova, Romania) use French.

The registration under the Madrid system is also distinguished by the absence of intermediaries (foreign patent attorneys); there is no need to conduct correspondence through third-party hired foreign lawyers and pay for their services. All correspondence of your patent attorney from Ukraine will go directly (via Switzerland) with foreign patent offices. Convenient “management” of the trademark after registration – in one language, through one International Patent Office (WIPO, Geneva), without involving other patent attorneys.

  To file an international trademark application, the following is required:

  1. A certificate registered in Ukraine, or a registration application sent to UANIPIO
  2. Actual details of the future brand owner for a legal entity (or surname, name, patronymic and address for an individual)
  3. High-quality image of the logo – electronic form (PDF, JPEG, PSD) or writing of the verbal part of the trademark (the same as in the national Ukrainian registration)
  4. A thorough list of goods/services (classes of the international classification) for which the international trademark is used or planned to be used in the future
  5. A specific list of countries of trademark registration
  6. Payment of all necessary fees
