Responsibility for photography and video filming during the war

The Verkhovna Rada of Ukraine adopted draft law No. 7189 “On Amendments to the Criminal and Criminal Procedure Codes of Ukraine regarding ensuring counteraction to unauthorized dissemination of information about the direction, movement of international military assistance to Ukraine, movement, movement or deployment of the Armed Forces of Ukraine or other military formations of Ukraine, committed under conditions of martial law or state of emergency.

 

WHAT HAVE CHANGED?

Consequently, the Criminal Code is supplemented by Article 114-2: unauthorized dissemination of information about the direction, movement of weapons, weapons and ammunition to Ukraine, the movement, movement or deployment of the Armed Forces of Ukraine or other military formations formed in accordance with the laws of Ukraine, committed in military or state of emergency. In particular, punishment in the form of imprisonment for a term of three to five years threatens for the dissemination of information about the direction or movement of weapons, weapons and ammunition through the territory of Ukraine, if such information was not placed in the public domain by the General Staff of the Armed Forces of Ukraine or the Ministry of Defense of Ukraine or in the official sources of the relevant departments of the partner countries, committed in a state of martial law or a state of emergency.

 

WHAT SHOULD NOT BE POSTED ON SOCIAL NETWORKS?

  1. Missiles flying or hit somewhere.
  2. Street names, bus stops, shops, factories.
  3. Movement of the Ukrainian military, military facilities.
  4. Air defense work.
  5. The place of the shelling or the impact of the projectile.
  6. Addresses, visual references or coordinates of battles.
  7. Numbers of cars, armored vehicles.
  8. Injured or dead (except official data).

Such violations are subject to criminal liability, as it is believed that such actions help. enemy, even if not intentional.

WHAT IS THE PENALTY FOR BREAKING THE REGULATION?

For the dissemination of information about the movement, movement or location of the Armed Forces of Ukraine or military formations, if possible, their identification on the ground, if such information was not placed in the public domain by the General Staff of the Armed Forces of Ukraine, committed in a state of martial law or a state of emergency, imprisonment for a term five to eight years old. Deprivation of liberty for a term of 8 to 12 years is punishable by the above actions committed by a group of persons with prior conspiracy or for the purpose of providing such information to the aggressor state, or if they entailed grave consequences.
