Christmas and New Year’s intellectual property

With the onset of winter holidays, the world is immersed in an atmosphere of fairy-tale magic that inspires artists, designers, musicians and entrepreneurs to create unique works. Ukraine, with its rich traditions and creative potential, is no exception. Every year, Ukrainians generate many ideas related to Christmas and the New Year, which are reflected in works of art, advertising campaigns, musical compositions, design solutions and innovative products.

The modern world requires the protection of such creative works, as they often become objects of commercial use, contribute to the formation of the national image and add value to brands. The registration of copyrights, trademarks, industrial designs and other intellectual property allows Ukrainian creators not only to protect their ideas but also to monetize them on a global scale.

Christmas trees

An indispensable attribute of the Christmas and New Year period is, of course, a festive tree. Most often, the world chooses something from the evergreen coniferous classics: fir, fir, or pine.

 By the way, the first documentary mention of a Christmas tree in Ukraine dates back to 1811, when a decorated tree was put up in the Potocki Palace in Odesa during a ball. Nowadays, holiday trees are decorated in almost every home, and now not only natural trees, but also artificial ones. Speaking of the latter. We now have a huge assortment of them: small and large, fluffy and solid, of various shapes and colors, sprinkled with artificial snow or decorated with built-in garlands.

For example, in 2008, a patent was registered in Ukraine for the invention of a large-sized Christmas tree. According to the description in the SIS, this invention consists of a trunk in the form of a prefabricated rod block, along which there are devices for fixing supports for pine needles. It differs from others in that the trunk is pivotally connected to the base at the bottom, and the supports are made in the form of rods of different lengths with lattice panels at the ends.

   It is worth highlighting the environmental solutions offered by Ukrainian innovators. In particular, in 2023, a patent was granted for a utility model of a prefabricated Christmas tree made of natural coniferous branches. This design consists of a wooden base to which natural branches can be attached in 360° rows around it. The stand for this Christmas tree is a wooden block with preserved bark. This solution allows us to preserve live coniferous trees, preventing their felling.

For those Ukrainians who decided to set up a solid tree, the inventors developed and registered as an industrial design special stands for the Christmas tree that securely and safely fix the festive tree.

Decorations and toys

            However, setting up a Christmas tree is not enough – to create the perfect holiday, you need to decorate it. It has been documented that the first Christmas trees in Europe were decorated with colored paper flowers, apples, wafers, tinsel, and sweets. Today, we have a much wider range of Christmas tree decorations, and Ukrainians are very inventive.

Ukrainian creators have received patents (certificates) for industrial designs of embroidered toys in the shape of a star, heart, glove, car, bird, angel, bell, Christmas tree, boot, airplane, and bottle. By the way, anyone can try to embroider a festive decoration on their own if they wish – they can use tips from special literature. For example, a collection of tips and patterns for embroidery with beads or thread that is copyrighted.

  And let’s not forget that to hang all this beauty on the Christmas and New Year tree, the toys must have special holders. Their design can also be an object of intellectual property. Like, for example, industrial designs of a pendant or a cap.

But, of course, the top of the tree is the most important part of the Christmas tree, so Ukrainian inventors made sure that we could choose a patriotic version – the trident (in this case, an industrial design).

Christmas and New Year’s themes in intellectual property are a vivid example of how a combination of traditions and modern ideas can generate unique creative products. Ukrainians are actively creating and registering objects that reflect the festive atmosphere, from musical compositions and artistic works to commercial brands and design innovations.

The protection of such intellectual property opens up wide opportunities for their monetization, participation in international projects, and popularization of Ukrainian culture abroad. It also contributes to the development of the creative economy, which is becoming an important component of Ukraine’s modern economy.

Christmas and New Year’s intellectual property created by Ukrainians is evidence that our art and innovations can be competitive on a global level, giving the world a special holiday spirit full of unique Ukrainian flavor.
